According to some of the commentary in the LA Times blogs regarding the SoCal Tsunami, it may well have begun...

Dear Brothers and Sisters, on behalf of the 81 organizers brought in from all corners "we apologize", Dave Regan and Anna Burger have threatened our livelihoods for the last time.

We were weak, we all believe in the labor movement, however, after 57 of us have been "laid off, pending review" we seek forgiveness.

While we here at ¡AA! generally subscribe to the notion that it is far better to ask for forgiveness than permission, it is regrettable that the forgiveness had to be asked for after having come out here to be a part of Andy's Zombie Army.

Pharmacy Agreement Going Down To Defeat?

That seems to be the word from NUHW headquarters, as enumerated in the following flyer that's going around to the KaiPerm offices throughout KPNC (click to enlarge)...



The fact that SEIU refused to openly count the ballots (in contravention to long-standing UHW tradition) is an indication that either a) the result was pre-ordained, or b) they don't trust their best-and-brightest stewards to get the "correct" result.

Either way, this was Zombie UHW's first real test within KaiPerm, and it appears that they are flunking that test. This one should have been a slam-dunk. The Zombies have been putting out press releases far and wide about how they have "saved 150 pharmacy jobs," but they forgot that one little part about how their agreement had to be actually ratified by the a bunch of workers whom were getting their hours cut conceivably by 40% in order to "save" those jobs.

1021 Shifts Aim, Still Hits Self In Foot



It seems that SEIU 1021 is none-too-pleased with Mayor Gavin Newsom of San Francisco, and have decided to put out a flyer illustrating their displeasure with Hizzoner...


So let's take a look at some of the claims being made by Plague 1021, and see if they stand up to scrutiny:


This is true. Concessions were made, depending on a "revenue" (read--> tax raise) measure being placed on the November 2009 ballot for the City and County of San Francisco.



Translation: "We depended on good actions of city Gubmint officials (acting as management) rather than actually getting those city Gubmint officials to agree to something concrete that can be contracturally enforced." Oops. Let's take a peek at the highlights of the most recent tentative agreement that SEIU signed, and what it has to say about this issue:



So, given the above, the flyer imaged above goes on to state...



Unfortunately, when making this flier, the nice folks at 1021 forgot that when this all was first boiling over, SEIU had to take three whacks at getting the TA language that would help the city solve its budget woes and "protect" their workers. Unfortunately for 1021, because they had to take multiple votes in order to get the correct outcome, the City and County of San Francisco had to go forward with a plan that would balance their budget in spite of 1021's concerns - and so they did, as detailed in an E-mail from Hizzoner's office to the SF Bay Guardian:
Haaland’s flier is indeed mostly lies. In the flier, Haaland spells Mayor Newsom’s name correctly, but that’s one of the last bits of accurate information you’ll find there.

When writing about the layoffs, why don’t you publish the facts instead of relying on the utterly unreliable Haaland? Here they are.

We originally balanced the budget around the assumption of the SEIU tentative agreement. When the agreement was voted down, we were forced to propose further reductions to balance the budget. These reductions included the layoffs scheduled to take place on November 15. The position eliminations and conversions added to balance the budget following rejection of the tentative agreement totaled $11.5 million, including:

When faced with the tradeoff between eliminating positions outright and doing things that would allow employees to keep their jobs, we made a concerted effort to help people keep their jobs. We believed this was also the preference of the SEIU leadership and rank and file.

All of the 546 layoffs were included in the budget deliberated and approved by the Board. The City discussed these plans extensively at the time at Board of Supervisors budget hearings and multiple Health Commission meetings.

Although it was not made explicit with SEIU at the bargaining table that there would be additional CNA conversions or clerical layoffs forthcoming, it was made clear that the SEIU agreement, that was later ratified, would not prevent any future layoffs. During subsequent budget hearings, these layoffs scheduled for November 15th became the subject of clear policy debates and tradeoffs during the budget process.

The Board of Supervisors restored $40 million in spending. Instead of restoring CNAs and clerical positions, the Board opted to prioritize restoring other services including the Jail Health Prop J worth $6 million, ($12 million annualized); multiple security Prop J’s worth $6.8 million ($13.6 million annualized); and janitorial services Prop J worth $2.6 million ($5.2 million annualized). Many of these Prop J proposals would not have resulted in a layoff but would have allowed employees to keep their jobs performing other city functions, such as public health nurses performing other services within DPH rather than providing jail health services.

Now that's not to say that Hizzoner has covered himself in glory in this process. Still, it is astonishing that SEIU is going out of its way to make flyers against Newsom that are calculated to make him so angry that he was described as having "lost his shit," and as such eternally pissed off at someone who (at least for the next year or two) they are going to have to deal with across the negtiation table.
“He said ‘this is a lie,’ referring to the flier. “I don’t want to do anything to deal with the union. I hate Robert [SEIU organizer Robert Haaland]. What you’re doing now is hurting me .... I hate Robert. I don’t want to do anything for the union.”
The above exchange evidently was hurtful enough to sufficient ears as to take the case to the California PERB, citing Hizzoner's statements as "intimidation and harrassment."

SEIU is not without complaint, but their complaint is without realistic merit, in that Newsom has not actively blocked any revenue measure from going to the ballot; instead, he failed to convince enough SF city councilcritters to agree to the measure, thus forcing the measure to be approved 67-33 rather than just by majority vote:
And the fact remains that Newsom promised the union that he would work toward a revenue measure, and then didn’t follow through. What he needed to do was convince the three supervisors he had personally appointed -- Sean Elsbernd, Carmen Chu and Michela Alioto -- that they should allow a November vote on revenue measures. If they’d gone along, the board would have been unanimous in agreeing to hold that election, and a revenue measure could have passed with a simple majority. Without the mayor’s three allies, thanks to oddities in state law, any tax measure would have needed a two-third vote.
Again, SEIU was depending on the actions of management to follow through on convincing others to do things that would be ostensibly against their better political interest. And oh by the way, this also was not contracturally obligated of Newsom.

We all know what really happened here: Newsom is running for governor, and he doesn’t want to be known as a mayor who raised taxes. So he promised the union that he would do something that he was never going to do.

That’s what it all boils down to, and that’s why it’s fun to see Local 1021 call him on it -- and why it’s instructive to see how fragile the mayor is when he’s pushed. Mr Mayor, sir: It’s not going to get any easier if you make it to higher office.

It has been known for well over a year that Gavin Newsom was running for the governorship of California. The fact that SEIU was unable (or unwilling) to pin Hizzoner down on such a point as to make it contracturally actionable should he not follow through lies not on Hizzoner but on the weak-ass negotiators hired and paid by SEIU 1021.

Otter said it best: "You fu@&ed up - - you trusted us!"

SEIU & KaiPerm Give Us The "F" Word, Revisited

Word is out amongst the KaiPerm EVS workers that SEIU has agreed (on their behalf) to institute the "F Word" to the bottom third of all EVS workers as well.

Remember - this is being done to "save" jobs that SEIU actively bargained away to KaiPerm. The jobs that they will be "saving" will be part-time (instead of full-time) and will no longer have set schedules, and can be modified at any time by management based on "operational need."

SEIU & KaiPerm Give Us The "F" Word...

...no, it's not what you are thinking, but it's pretty darn close. It turns out that a big chunk of those 150 Pharmacy jobs that Zombie UHW was bragging on having "saved" bear little, if any, resemblance to the jobs that were pink-slipped in the days leading up to the August 4th agreement.

Once again, Zombie UHW has not released the text of the agreement to its affected members - it has taken NUHW representatives to put it out to the people, and the agreement can be accessed by clicking here.

It's not like this most recent "victory" on the part of the Plague will affect just those pharmacy employees that were pink-slipped - after all, this is SEIU, and SEIU doesn't play that way. No, friends and neighbors, this agreement will affect up to one-third of the entire Pharmacy staff of KPNC, and it will affect them in a way that the prior leadership of UHW did not allow KaiPerm to do back in the 2005 negotiations. I'll let NUHW explain:

Dave Regan Continues His March Backwards with Our Contract

With the recent Northern California Pharmacy Agreement SEIU agreed to allow a full third of benefited employees in the Pharmacy to give up their guaranteed hours. SEIU, also as usual, had side conversations during the bargaining where no members were present. SEIU agreed that:
  • Up to a full third of the current benefitted Pharmacy employees will be affected by this change— many more employees will be affected than were given notice of job elimination.
  • Current Full Time Employees may be required to take 24+ positions. When the Pharmacy is busy they will work their former full time schedule but when work is slow they can go down to 24 hours a week.
  • Pharmacy workers will be required to travel to other facilities.
  • Pharmacy workers will have their start times changed whenever it suits the Employer.
  • On‐call employees won’t be needed as before because the benefitted workers have taken their place. Before, a part‐time employee could say no to additional hours—Not anymore.
  • The agreement is full of loopholes and easy for Kaiser to interpret to its advantage and disputes are not subject to the grievance procedure but are sent to some Committee.

With the Scare of Layoffs, Was this What Kaiser and SEIU Planned?

In bargaining in 2005 and in years past Kaiser has attempted to get this concession from us and we said no. SEIU has given away what we were always able to stop.
  • How can benefitted workers make financial plans if they have no guaranteed hours?
  • How can single parents plan for childcare?
  • How can workers go to school?

This is all about the “F’ Word = Flexibility

SEIU has now conceded to Kaiser that having a regular assignment with regular hours is a thing of the past. This will now be what happens in all the classifications hit by lay off notices. What Kaiser and SEIU want workers to say is: “I’m‐just‐glad‐I‐have‐a‐job.” How things have changed!!

Kaiser is in charge and we are being flexed. It’s not about the economy. Kaiser has wanted this for years and now SEIU has agreed to flex us. Even SEIU says Kaiser has no economic problems.

Kaiser and SEIU have flexed us. Yes the “F” word!!!!!

Zombie UHW Forced To Live Up To Own Agreement



Yesterday's edition of the Sacramento Business Journal had an article entitled, "Kaiser Workers Rally Against Job Cuts."

That's kinda funny, considering how it was SEIU and Zombie UHW that entered into negotiation with KaiPerm and agreed to those job cuts. So I guess Zombie UHW is going to be protesting itself, right? Uh, no...

Union workers are picketing Kaiser Permanente’s South Sacramento Medical Center on Tuesday to protest company plans to slash 1,350 jobs in coming months to offset enrollment losses and declining margins.

A total of 48 jobs are in jeopardy at the South Sacramento hospital, according to Service Employees International Union-United Healthcare Workers West. The union represents 1,438 radiology and operating room technicians, environmental service and others at the medical center and surrounding clinics.

Pickets are planned from 11:30 a.m. to 1:30 p.m. at the hospital on Bruceville Road and at Kaiser’s regional office in Pasadena.

North and South they go, and when they'll stop spinning, nobody knows...
“We’re here to show our faces and say we don’t approve of the layoffs and want to sit down at the table and bargain over this,” said Keturah James, a union member who works in hospital staffing at Kaiser’s South Sacramento hospital.
Unfortunately, Keturah, your union already HAS sat down at the table and bargained over this - and has given away almost 50 jobs at your facility - for nothing in return. Mighty sporting of the Purple Plague, dontcha think?

Not surprisingly, KaiPerm is in no mood to go back to the table and give back what was so easily bestowed upon them by Zombie UHW...

The union is mad that Kaiser sent out job elimination notices in August shortly after it kicked off the voluntary separation plan and claims picketing has brought management back to the table.

A bargaining session on the proposed job eliminations in Northern California will be help Sept. 30, union officials said.

Kaiser management will attend the Sept. 30 meeting to “discuss and share information regarding the implementation of the agreement signed by SEIU-UHW on Aug. 3,” Westfall said in an e-mail Tuesday.

“We believe that this unique agreement and the intensive engagement that led to it more than fulfilled our bargaining obligations. Kaiser Permanente has honored the agreement and expects SEIU-UHW to do the same,” she said.

Management continues to meet with SEIU-UHW and other unions to implement the process — but all future meetings about job eliminations will be for this purpose and not to renegotiate the agreement already signed, she said.

Folks, the above paragraph can be distilled down into two words: Pound Sand.

Well done, Zombies. Hope you like that bed y'all built for yourselves.

One other question - why is it that the same people keep showing up at all the protests, even though they're at different locations?

Friday Wrap

1) It appears that Our Glorious Maximum Leader has been asked to sit on an advisory board tasked with making sure that ACORN no longer helps perpetuate child prostitution through its offices. Some jokes just write themselves.

2) The NLRB is most decidedly NOT your friend. Sure, you can participate in union activity while on your job - but according to the NLRB, just not too much, and not at the expense of SEIU.

3) Remember those layoffs that SEIU swears that cannot and will not occur on its watch, and are the basis for the "We Didn't Really Negotiate For Layoffs (eventhoughwereallydid), We Promise!!!" Informational Picket Tour of California? They keep saying in their pressers that they're walking the line to protect jobs of people like this guy...

Zombie UHW Taketh, Zombie UHW Giveth Away...

The brain-sucking undead minions of Zombie UHW started circulating a flyer this week proclaiming their guarantee that nobody at KP will be laid off...



Of course, nobody believes that jive, especially the people who just got pink slips last Tuesday.

It is also noteworthy that the above flyer is self-contradictory:

Yo, Zombies - if you have an "Agreement" that guarantees there will be no layoffs, then why do you need to "continue our member-driven campaign to fight them"?

There's only one answer to the above question: It is Zombie UHW who is responsible for those pink slips going out the other day in the first place!

This can be seen from the actual agreement that was signed on August 4, 2009, by some of the representatives of the Coalition of Kaiser Permanente Unions.

That's right, "some." In fact, there are 16 CKPU members in California, but only FIVE of those unions signed off on this agreement, those being USW, OPEIU-30, OPEIU-29, UNAC, and of course Zombie UHW. Of those five signatories to this agreement, one organization has a level of membership that trumps all others, and that is Zombie UHW.

Had Zombie UHW walked away from this "Agreement" and instead insisted that the contract be lived up to as signed back in 2005, then there would have been no pink slips!!! There would be no need for pickets or protests. There would be no need to brag about a guarantee of no layoffs on one part of a flyer, with a pledge to continue to fight the layoffs that have been guaranteed that would not occur.

Damn. Now I've got a headache from trying to follow the Zombie UHW rhetorical spin.

I will give a more in-depth analysis of the Great Zombie UHW Sell-Out in a subsequent post, but some points absolutely need to be hammered home:

ZOMBIE UHW IS RESPONSIBLE FOR ANY IMPENDING LAYOFFS.

ZOMBIE UHW ENTERED WILLINGLY INTO AGREEMENT WITH KAI-PERM TO LAY OFF EMPLOYEES EVEN THOUGH THERE WAS AND IS NO FINANCIAL NEED FOR KAISER PERMANENTE TO DO SO.

ZOMBIE UHW IS LYING TO ITS MEMBERS WHEN IT SAYS IT CAN GUARANTEE THERE WILL BE NO LAYOFFS, BECAUSE PINK SLIPS HAVE ALREADY GONE OUT, AND TRANSITION POSITIONS HAVE ALREADY BEEN ELIMINATED!

Folks, wake up. You are not being served by SEIU; instead, we are all collectively being SCREWED by SEIU.

What Color Is The Sky At SEIU?

Evidently, a bright shade of purple. Here's what Zombie UHW has to say in regards to the layoffs:
"SEIU-UHW members and Kaiser have reached an agreement that will protect the jobs of caregivers across California. Despite Kaiser's insistence on eliminating some positions in the state, this agreement will ensure that no SEIU-UHW members are laid off.

"We don't think it's necessary to eliminate any positions, given Kaiser's strong financial performance this year. The company earned $620 million in the second quarter alone, far above their projections. Given that performance, we are disappointed that Kaiser saw fit to send out notices to individual employees notifying them that their positions were being cut. This will unnecessarily alarm those individuals, even though we have negotiated strong options to avoid actual layoffs.


"We intend to keep pressing the Kaiser to maintain the staffing needed to continue providing the highest level of patient care. We will be conducting votes to authorize statewide informational picketing in the coming weeks in order to hold Kaiser to all agreements it has entered into with us, and to force them to take all steps necessary to maintain safe staffing and ensure that no SEIU-UHW members lose jobs."

So, no layoffs, right? WRONG. From BeyondChron:
Last week, 1800 SEIU workers received notices from Kaiser regarding their job status, and while media accounts said there were no union layoffs, NUHW claims otherwise.

Here’s what Kaiser distributed to these workers:

Like all health care organizations, Kaiser Permanente has been affected by the difficult and uncertain business and economic climate. Unfortunately, it has become clear that we must make some workforce adjustments. As a result, we need to notify some employees that their positions are being eliminated.
Therefore, we find it necessary to provide you with a sixty (60) day notice that your position is being eliminated.

As a result of this notification, you will immediately be placed into the redeployment and transition process. The Employer and Union will work with you during the redeployment and transition process in an effort to find you opportunities for job placement.

If we are unable to locate a job opportunity for you by October 19, 2009, you will have a choice between a voluntary severance package including wages and benefits or remaining in a redeployment and transition status. You will be provided with more detailed information on these options during the week of October 19, 2009.
The above italicized section is an exact copy of a letter I had seen that went out to one of my colleagues last Tuesday.

There is no way that the above section can be interpreted other than KaiPerm is fixing to lay people off, and people who got the above letter were ALL covered by Zombie UHW. But according to SEIU, nobody's getting laid off.

Someone wanna help me pound SEIU's square peg into Kaiser's round hole?

SEIU's phony pickets will do nothing to dissuade KaiPerm from going through with these layoffs.

I have a strange feeling that there is going to be a lot of red shirts showing up at the SEIU informational picket sessions.

Strong Letter to Follow...

Well, folks, it seems that Sutter Health Systems has decided to do a bit of layoff action at California Pacific Medical Center. It's a good thing that Zombie UHW is on the case...

"We want to assure the public that we will pursue every avenue possible to protect these jobs and vital patient services," said Dave Regan, Trustee of SEIU UHW, which represents roughly 5,000 workers at Sutter. "We are holding Sutter management accountable and will make sure that they are not using the economy as an excuse to cut staff and harm patient care."

  • Sutter's endowment was $3.3 billion in 2007 and, despite dips in investments, remained at roughly $3 billion at the end of 2008.
  • However operating revenue grew from $7.65 billion in 2007 to $8.28 billion in 2008, demonstrating that Sutter Health has continued to grow even during the economic downturn.
  • While a 'non-profit' legally, for the last five years Sutter has reported operating income exceeding $428 million each year.

"People across California are losing their jobs, and the health care industry is not immune," said Marcelino Robies, a 28-year environmental services employee at Sutter's CPMC in San Francisco. "However, if Sutter cuts 200 workers, the quality of the service at the hospital will go down. That is why we need to unite as health care workers and with the community to fight for our families and patients."

SEIU UHW members expect and demand that Sutter CPMC negotiate over any decision to cut jobs and risk quality patient care: "We will be holding management accountable for every lost job and every lost hour of work time, ensuring that Sutter pursue every avenue possible before making those cuts," Regan said.

Oooh, good one there, Dave. I'm sure that the Sutter Bigwigs are just quaking in their boots at your expression of a threat of expectation of accountability.

SEIU - Looking Out for the Common Worker?

...Uh...NO.

Savor with me, won't ye, this rich, delicious, heaping helping of irony, courtesy of the WashPost:

The Service Employees International Union, considered the most influential union in the nation, has notified the union that represents about 220 of the SEIU's national field staff members and organizers that it is laying off 75 of the employees.

In return, the workers union, which goes by the somewhat postmodern name of the Union of Union Representatives, has filed charges of unfair labor practices against the SEIU with the National Labor Relations Board. The workers union's leaders say that the SEIU is engaging in the same kind of practices that some businesses use: laying off workers without proper notice, contracting out work to temporary-staffing firms, banning union activities and reclassifying workers to reduce union numbers.

"It's completely hypocritical," said Malcolm Harris, president of the workers union. "This is the union that's been at the forefront of progressive issues, around ensuring that working people and working families are taken care of, but when it comes to the people that work for SEIU, they haven't set the same standards."

Not so, sez The Purple Plague - it's just all part of Our Grand Plan:

SEIU officials say the layoffs are part of a long-running plan to reallocate resources. Its national office will devote more of its resources to lobbying and communications in Washington to take advantage of Democrats' ascendance. Most organizing would be left to local chapters, where officials say they have identified dozens of openings for the laid-off staff.

"This is not a financial issue," said SEIU President Andy Stern. "We need to respond to the once-in-a-lifetime opportunity our members created by helping elect President Obama."

I can't help but to interject some appropriate cinematic clarification here, which will closely approximate what Our Glorious Maximum Leader was trying to impart in the above quote:



Of course, some folks don't think that this is all just a Part of the Purple Plan:
But Stern has more recently emerged as a lightning rod. His coalition, Change to Win, has foundered, as several unions have moved back to the AFL-CIO or are considering doing so. He is also engaged in a costly power struggle with the former elected leaders of one of the SEIU's largest chapters, in Northern California, who were ousted by the SEIU two months ago and are vying with it for the loyalty of the chapter's members.

Harris said his union's understanding is that the layoffs are the result of budget troubles faced by the SEIU, which, on top of the California dispute, spent $80 million during the 2008 election and is planning to spend tens of millions more to advocate on behalf of Obama's health-care plan and card check.

Harris said SEIU leaders have made clear that the laid-off employees will not be guaranteed jobs at local chapters. In the case of organizers who are rehired by local chapters, he said the SEIU national office would still subsidize their salaries and help supervise them, but by classifying them as working for local chapters, they would no longer be covered by Harris's union. Fewer than half of the workers at SEIU chapters are unionized, and Harris's union's contract with SEIU forbids it from trying to help organize SEIU employees in local chapters.
Irony...sweet, dripping Irony...

But wait, there's MORE!
The SEIU's national office has been contracting out more and more work to a staffing agency, Harris said, including advocacy for card check. He said it looks as though SEIU is trying to phase his union out of existence.
Contracting? SEIU is contracting its admin work while laying off staff at the same time? SEIU is contracting advocacy for EFCA?!?

Pardon me while I try to refocus my eyes on that one...

Well, irony so deep and so delicious leaves us with a taste for a chaser of SEIU double-speak, and nobody gives SEIU double-speak better than our very own Baghdad Michelle:
SEIU spokeswoman Michelle Ringuette said the contracting is limited and denied that SEIU is trying to undermine the workers union. "That would be the cynical way of looking at it," she said.
Cynical? US?!? Surely you jest, madame. Especially in light of this revelation from the LaborNerd board:
In addition to the NLRB complaint, it appears that UUR has also filed a complaint with the Equal Employment and Opportunity Commission (EEOC), alleging both age and racial discrimination. Apparently the 75 layoffs are mostly middle-managment as opposed to upper managment positions. These occupied positions are laregly by middle aged people of color who suggest that they were passed over for promotions in favor of younger, white employees.
Nope. No cynicism here. Carry on...
